These Terms govern your use of the online booking and payment facilitation service (the “Service”) provided through Charterpro. The Service enables you to book activities and tourism services offered by independent providers (each, a “Provider”).
When you complete a reservation or purchase a Provider’s service through the Service (a “Booking”), you enter into a direct contractual relationship with the Provider (the “Activity Contract”). Charterpro is not a party to the Activity Contract.
The Provider is solely responsible for: (a) performing the Activity Contract; (b) communicating all relevant rules and policies (including cancellation rules, safety requirements, and restrictions); and (c) ensuring the accuracy and completeness of the service information displayed through the Service.
The Platform does not own, sell, furnish, provide, rent, manage, or control the Provider’s services and does not act as the Provider’s agent. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between the Platform and the Provider.
Payments for Bookings are processed via third-party payment service providers. Depending on the booking flow, amounts payable under the Activity Contract may be collected and settled to the Provider, and the Platform may collect a Booking Fee (if applicable) for providing the Service.
By submitting payment details, you authorize the Platform and the applicable payment service provider to charge (or pre-authorize) your payment method for the Activity Price and any applicable Booking Fee, taxes, and permitted adjustments.
The Service is intended for individuals who can form legally binding contracts. Unless prohibited by applicable law, you must be at least 18 years old to use the Service. You represent that you have the legal authority to enter into these Terms and to make a Booking for yourself or for another person you are authorized to represent.
If you book for another person, you are responsible for ensuring that the person is informed of and agrees to the Provider’s policies and the Activity Contract terms.
You agree not to use the Service to circumvent payment of any fee due for the use of the Service, including by locating a Provider through the Service and completing the transaction outside of it.
The Platform may charge a fee for enabling you to book and pay for a reservation through the Service (the “Booking Fee”). If a Booking Fee applies, it will be clearly displayed before you confirm your Booking.
Refunds: Unless otherwise stated in writing, Booking Fees are generally non-refundable as consideration for the Service, even if the Provider refunds part or all of the Activity Price.
Cancellation and refund rules for the Activity Price are set by the Provider and will be shown during the booking process or in the Provider’s terms. You agree to comply with the Provider’s rules.
The Service may occasionally display technical inaccuracies or errors (including prices, fees, or availability). The Platform may correct such errors and, where required, coordinate with the Provider to confirm or cancel a Booking if necessary to correct a system or data error.
The Service may be unavailable from time to time due to maintenance, repairs, internet disruptions, or other circumstances beyond the Platform’s reasonable control.
You agree not to:
The Service and its content are protected by intellectual property laws. You may use the Service solely for its intended purpose and may not copy, modify, distribute, or create derivative works without permission.
Personal data are processed in accordance with applicable data protection laws. Payment processing is performed by third-party payment service providers. The Platform does not store full card details.
Provider GDPR statement: The Provider declares that it has complied with the obligations set forth in Regulation (EU) 2016/679 (GDPR) and that it provides end customers with an appropriate privacy notice regarding the processing of personal data.
The Platform may suspend or terminate access to the Service where reasonably necessary, including in the event of misuse, breach of these Terms, fraud prevention, security reasons, or legal compliance requirements.
Any dispute regarding the performance of the Activity Contract (including injuries, losses, damages, service quality issues, or cancellations) is between you and the Provider. The Provider is solely responsible and liable for the services it provides.
To the maximum extent permitted by law, the Platform will not be liable for indirect, punitive, or consequential damages arising from your use of the Service. The Platform’s total aggregate liability (if any) will not exceed the Booking Fee paid for the relevant Booking (or, if no Booking Fee was paid, EUR 100), except where liability cannot be excluded under mandatory law.
These Terms are governed by the laws of Italy. If you are a consumer, you may also benefit from mandatory consumer protection laws in your country of residence. Any dispute shall be submitted to the competent courts, with exclusive jurisdiction in Naples, Italy, without prejudice to mandatory consumer rights.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
These Terms, together with the Privacy Policy and any booking-specific terms shown during checkout, constitute the entire agreement between you and the Platform regarding the Service.
